- Which form, when
- Simplified AOC-238.1/239.1 'FOR PARTIES WITH COMBINED INCOME LESS THAN $100,000 AND COMBINED ASSETS LESS THAN $100,000' (printed on the form; FCRPP text itself names only AOC-238/239 and states no threshold); otherwise AOC-238/239. FCRPP 2(3) (preliminary) and 3(3) (final), Order 2020-1 eff. 1 Feb 2020.
- Filed or exchanged
- Preliminary (AOC-238): exchanged within 45 days of service, objections 21 days later, and 'shall not be filed in the record unless ordered by the court or required by local rule' (FCRPP 2(3)). Final (AOC-239) or AOC-239.2 affidavit: if financial claims are tried, served 21 days before trial and filed no later than 14 days before trial (FCRPP 3(3)(c)).
