Filed with the court, or given to the other side?
It is given to the other side, and a proof of delivery is filed. The affidavit itself is filed only if a local rule or court order requires it.
The rule in full, with its sourcesExactly what we confirmed, with the rule each part comes from.
- What it uses
- One Supreme Court-approved Financial Affidavit (Family & Divorce Cases) that must be used in every circuit, with optional 'Additional' overflow sheets.
- Which form, when
- Statute: 'One form of financial affidavit, as determined by the Supreme Court, shall be used statewide' (750 ILCS 5/501(a)(1)); footer: 'approved by the Illinois Supreme Court and is required to be used in all Illinois Circuit Courts.' No income tiers.
- Filed or exchanged
- Must use, but filing is local: the form says 'Only file this document and any attachments with the Circuit Clerk if a local rule or court order requires you to do so' and to deliver it to the other party and file a Proof of Delivery.
This is general information, not legal advice. Forms change, so check with the court before you file.
