The Confidential Financial Affidavit is filed with the court clerk and served. The Initial Disclosures are only served, not filed, within 30 days after the answer is due to be served.
The rule in full, with its sourcesExactly what we confirmed, with the rule each part comes from.
- What it uses
- Wyoming splits disclosure by issue across statewide forms. The Confidential Financial Affidavit covers income and support (Wyo. Stat. § 20-2-308) and is filed. The Initial Disclosures schedules cover assets, debts, employment and retirement (W.R.C.P. 26(a)(1.1)) and are served but not filed. Plaintiff and defendant packets carry different numbers for the same forms.
- Which form, when
- Divorce with children: Confidential Financial Affidavit (DIVCP 11 plaintiff / DIVCD 08 defendant) plus Initial Disclosures (DIVCP 10 / DIVCD 07). Divorce without children: Initial Disclosures only (DIVNoCP 09 / DIVNoCD 07); that packet has no affidavit. Affidavit required before any child support order (Wyo. Stat. § 20-2-308(a); MISC 19 order); disclosures in every divorce, pre-decree and post-decree as relevant (W.R.C.P. 26(a)(1.1)).
- Filed or exchanged
- The Confidential Financial Affidavit is filed with the Clerk of District Court and served (its certificate reads 'the original of this document was filed with the Clerk of District Court'). The Initial Disclosures are served only ('DO NOT FILE THIS FORM WITH THE COURT'), within 30 days after the party's answer is required to be served (W.R.C.P. 26(a)(1.3), rules eff. 9-21-26).
